Can I file for an out-of-state divorce?

More details to this question:
I live in Texas and my husband in Florida. Our divorce will be simple. We got married in Florida. Can I file for divorce from Texas? Do I need to go to Florida court?

If you have been in Texas long enough to establish jurisdiction there, and you both are in agreement upon everything, then you probably can file in Texas, though you need to confirm this with a Texas attorney.

You can file for divorce in Texas as long as one party has lived in state for 6 months and the county in which you file for 90 days. It does not matter where you were married or that both parties reside in Texas.

If every issue in the divorce can be agreed to, you can probably get an uncontested divorce in FL rather inexpensively. The filing fee alone is $409. In order to find out if you can get a divorce in TX, you would have to ask lawyers there. In FL one of the parties has to have been a resident for over six months, and the marriage has to be irretrievably broken. Where does he live in FL?
