QUESTION

Can I get a divorce overseas?

Asked on Sep 20th, 2014 on Divorce - Florida
More details to this question:
Iโ€™m a non us citizen (Egyptian) used to live in in the states 8 years ago. When I got married to a US citizen years later, we got separated and I left the US in 2010 before applying for my green card. I moved to out of the country and got married again to a non US citizen as my second wife (laws in UAE permit Polygamy). Itโ€™s have been 5 years now and I would like to apply for a B2 visa to visit the US and get divorced from my first wife. Do you think I could be charged for Polygamy in the embassy of USA in DUBAI?

Probably not but you do need to file in the USA to divorce the first wife. Use of a lawyer is recommended.

Depends on the laws in effect in Dubai. Check with the local Dubai authorities, Dubai may have jurisdiction to grant a divorce.

You question is extremely complex. You have to be a resident of FL for six months before you can file a divorce here.

Your question is a good one, however, you should probably ask an attorney who specializes in Immigration and Criminal/International Law. Those are areas of specialization and those attorneys would be more likely to have your information than Family Law practitioners. Good luck.
