QUESTION

Can I get an annulment and how?

Asked on May 20th, 2015 on Divorce - California
More details to this question:
I got married 4 months ago to a man who started being verbally and physically abusive shortly after we were married. It got so bad that I told him that I am going to file a restraining order. If I do that, will it be grounds for an annulment? Or can I already file for annulment because he is abusive and we were only married 4 months ago?

As long as the marriage was consummated you can get a divorce but not an annulment. You can file a domestic violence protection order if he was abusive. This has nothing to do with whether or not you get a divorce, but you can have the cases consolidated if you file for a divorce.

You can request an annulment, but more likely you will qualify for a divorce. You should immediately see a family law practitioner.

It's harder to get an annulment than a divorce. Why not just do it the (relatively) easy way? Consult an experienced family law attorney.

Generally, an annulment isn't an option unless you meet one of the specific categories set forth in the family code. Plus, they require a hearing to prove the claim. If you are only married 4 months and there is likely no community property to divide, it is quicker and easier to just file for divorce.
