QUESTION

Can I remove a shed from marital residence after property settlement?

Asked on Nov 26th, 2012 on Divorce - Florida
More details to this question:
My soon to be ex and I signed property settlement papers a few months ago. He got the marital residence and all the debt that goes with it (he let it go into foreclosure while our children and myself were living there). The bank is to take over ownership and put it up for foreclosure in less than a month. My question is this, we are still married, he still owns the home, there is a detached shed on the property I would like to take to my new residence (it wasn't listed in any court documents), can I have the shed removed and delivered to my new residence before the bank takes ownership?

Anything attached to the ground is part of the real estate and title to it goes with the house. If it is not attached, it is not part of the real estate. I suggest you contact the mortgage holder and request permission to remove the building.
