QUESTION

Can my ex-spouse claim spousal support after she waived it 5 years ago?

Asked on Mar 11th, 2016 on Divorce - California
More details to this question:
My divorce was in 2009. Because of my high payments of child support it was in her own recognizance to waive spousal support. Now that child support has stopped because the kids have emancipated she is treating to take me back to court for spousal support. Can this be possible?

If there was a true waiver it should stand. An attorney will have to review your court judgment to see if your waiver was done correctly.
