Can my husband drop me from his insurance while we are separated?

More details to this question:
My husband and I have been separated for 6 months, after a 21 year marriage. He is going to drop me from the medical insurance, can he legally do that while separated? I have been covered under his insurance for the past 21 years.

Yes, unless you file for divorce or legal separation and request continuation during the pendency of the case.

In California the standard restraining orders prohibit either party from making changes in the insurance during the pendancy of the action.

In California, yes, he would be able to drop you from his insurance coverage if you are legally separated because the separation terminated the community estate.

It seems unlikely that he can drop you if you are still married. This also depends on the nature of the health insurance and if they have a provision for separated couples. You should consult with an attorney right away and show him whatever you received from the insurance company.
