Asked on Oct 15th, 2013 on Divorce - New York
More details to this question:
We are currently married. Starting divorce proceedings. We do not own our home. The company he works for owns it. We live on their property. He says if I refuse to leave he can have his employer evict me. He is doing this because I refuse to waive my rights to his retirement and pension.

You should waive nothing and contact a local divorce attorney immediately. Evictions are governed by landlord tenant law - and your rights may depend upon whether you have a lease as well as what town you're in.

You should retain a lawyer to address your rights in the divorce and prevent your husband from trying to force you out. Note that once you are living separately, he may have an obligation to pay you temporary maintenance during the case. Talk to an attorney near you for a more detailed answer. Good luck!
