QUESTION

Can one party revoke Marriage Settlement Agreement?

Asked on May 19th, 2013 on Divorce - Florida
More details to this question:
I live overseas. My wife and I signed Marriage Settlement Agreement on August 16, 2012. She was supposed to file for Uncontested Divorce, because we signed as her being the Plaintiff. But she has not filed. But she moved my belongings to a shed which she bought taking money from my personal account with signed checks. Now she says, if I want a divorce I should file for it. Questions: Is Marriage Settlement Agreement still current. Can she revoke it saying she no longer wants uncontested divorce? Can I file it with the Agreement, which I am listed as Defendant? Thank you.

The agreement should still be valid, And you file for divorce as the plaintiff. It doesn't really make a difference.

You would need to file an Answer and Counterclaim. You then need to submit all the correct documents to complete the divorce. If you are not in state, it makes sense to hire an attorney to get this done for you.

Start with your sister and see jurisdiction/case number where her rights were terminated. You may be able to track it from there, unless confidentiality laws prevent it.
