QUESTION

Can we finish divorce without an attorney?

Asked on Jan 29th, 2015 on Divorce - Florida
More details to this question:
My estranged spouse has been served with divorced papers and is not contesting divorce. We have 1 child where child support is already set by state. We do not have a custody plan, but plan to agree on a custody plan, what happens next? We do not want to go to court. We have been separated since December 2013. I have paid 2 lawyers and still no divorce.

The Court requires a parenting plan to be reduced to writing and approved by the court so. If you and she agree then start there. Use of a lawyer is recommended.

Mediation should happen next and the mediator might help you hammer out an agreement. But you have to look into how to get this done if you are going to do it yourself. You have to learn the right procedure to follow.

You might want to consider firing the attorneys and retaining someone that can assist you in filling out the necessary forms. One of you may have to appear in Court for a final hearing. Good luck.
