QUESTION

Divorce and Alimony for Military

Asked on Feb 08th, 2013 on Divorce - New York
More details to this question:
I am looking to divorce my husband. We have been married for 11 months but have never had the same address. I found out after we got married that he only married me to get BAH from the military. He is an E5 and made about 1500 a month. He kept his money in a separate bank account and only gave me maybe $500 a month for 2 months. When he got home from deployment he moved away and I have not heard from him since September. I do not know where he is but if he is still in the military he is still collecting money that should be going to me. From what i have researched this is BAH Fraud and Abandonment in the militaries point of view.

Your divorce may be complicated by the New York Soldiers and Sailors Act, but you can still get a divorce from him. If you are not living together, you may have a hard time arguing that he should pay any alimony ("maintenance"). Additionally, this was a short term marriage so it further decreases your chances for maintenance.
