QUESTION

Divorce, finances and health insurance

Asked on Nov 05th, 2012 on Divorce - New York
More details to this question:
My husband and I cannot agree on dividing finances. We had no prenup and for the last three months I have been the only one earning an income. Are we each entitled to half, or is he entitled to his original contribution? Additionally, he is carried on my health insurance. He lives in another state now. What implications do I need to consider if I discontinue his coverage at my open enrollment?

Update Your Profile
If you have commenced a divorce action you can not change insurance. As to finances without more information it's not possible to be precise about what the scenario would be. Generally the rule is that, except for inheritances or awards for personal injury, anything of value received during the marriage is marital property to be divided 50-50.
