divorce or marriage annulment

More details to this question:
im a us citizen married to an illegal alien, we never lived together and neither of us meet residency requirements in ny, i was a va resident at the time who had just recently moved to ny, now im an ivory coast resident. however we are married in ny, we dont share any property or children and i am living in africa with my family and i want to know how to get a divorce or anullment, he will not file there because he believes that being married will get him his green card

If you don't meet hte residency requirement and he doesn't meet the residency requirement you can not file in New York. Once he meets the requirement you can file here. Why not file in the Ivory Coast?
