QUESTION

Divorce settlement

Asked on Dec 23rd, 2013 on Divorce - New York
More details to this question:
My case is slightly different, I have many questions but my main question is after a year of marriage my spouse wants a divorce and has offered me $300 a month in support. Is this acceptable? We don't have any assets to split I.e a house or cars or children, however he works for the FBI and is paid fairly well around $3000 or more a month. And I feel although I'm entitled to more especially since I didn't initiate the divorce and he has left me to struggle.

If you've only been married for a year unless there's more (like children involved) $300 per month could be a lot more than a court would award.

Maintenance ("alimony") can be tied to a number of factors, including the length of the marriage, the standard set during the marriage, and your ability to support yourself. Without more information, it is really difficult to say whether this is a fair offer. You also don't say how long he's going to pay the monthly amount. Talk to an attorney who can evaluate the case based on all the facts. Good luck!
