These papers do not expire if they have not been filed. However, only one of you will sign and file a petition for divorce. The other spouse will file an answer and potentially a counter-petition.

In Sacramento County, the courts file a dismissal of cases after five years if the courts have sufficient staff to handle housekeeping matters. You and your husband have time to think things over. If you decide to go forward check with the court to see if your case number is still active. Good luck to you both.

A case is usually dismissed after one year of no activity. The clerk will notify the petitioner before this is done.
