Do I absolutely have to get a divorce or do I have another option?

More details to this question:
I have two children by a man I was with for six years and have been separated for eight. we have not been together since 2005. while together we filed taxes together a couple years. I have been told I have to get a divorce and I've been told I don't have to I just have to file for custody and child support. there are no outstanding bills or anything to divide between us considering we have been leading our own lives for eight years. I'm currently engaged and have set my wedding back because of what I have been told recently.

Yes, you have to get a divorce. Marrying someone while you still are married to someone else is a crime in Colorado (bigamy).
