QUESTION

Do I have to call my wife's attorney back?

Asked on Jun 17th, 2014 on Divorce - Florida
More details to this question:
My wife's attorney called and left a message for me today. I filed a motion to extend time so I can save money and make arrangements with attorney. Also today, I and her lawyer received the email from court with regard to judge's hearing for extension. Do I have to call them back?

Until you have engaged an attorney to represent you, it would be foolish not to communicate with your wife's attorney, and ultimately more costly for everyone. By not communicating, you don't even know if they were going to agree to a reasonable extension so that you all can avoid the time and expense of attending a hearing upon your motion. You don't have to agree to anything, but you should at least communicate until you engage an attorney of your own to do so for you.

Get an attorney, and the attorney will call them back.

In as much as you will be retaining an attorney, you might want to consider NOT returning the other attorney's phone call, but having your attorney return the call. If, however, you fail to act promptly in getting an attorney, your spouses attorney will probably go to Court to get whatever he/she desires.

No, you don't have to, but I would. The attorney could be calling to discuss the granting of an extension without the need for a hearing, to schedule a hearing, or even make a settlement offer. It can't hurt to return the call, but if you don't act you may regret it.
