QUESTION

Do I have to send the documents requested or can I just sign, send them back and be done?

Asked on Nov 15th, 2012 on Divorce - California
More details to this question:
My husband has filed for divorce and included that I submit tax paper for three years. There are no children in the marriage. The paper request I submit paystubs, tax papers for three years and proof of insurance. We had nothing of the sort connected. We were married for eight months, not even joint bank accounts. I am giving back to him what he requested. He has also waived the 90-day grace period.

If the request for production of documents conforms with the applicable court rules, you have to answer and either file a valid objection or produce the documents.

It sounds like you are living in Colorado and, if that is true, the court rules require that both parties exchange copies of all relevant financial documents without being asked for anything. The minimum 91 day waiting period for the court to issue a final decree cannot be waived by anyone.

You have to give him the papers or he can have a judge order you to pay a fine and attorney fees. There is nothing secret when you file for divorce even if it was secret during the marriage.

You can object. But it may be easier to comply.
