It is not required that you have your husband's signature in order to obtain a divorce in New York. The more important issue is that you are able to locate your spouse in order to have him served with the Summons for divorce. Once he is served, if he fails to actually file an appearance with the Court to contest the divorce within a certain period, you may proceed on obtaining a Judgment of Divorce by default (without his signature).
