Does my ex-wife qualify for Alimony in California?

More details to this question:
I just served my ex-wife divorce forms in California, she hasn't respond yet but she also threating me with alimony. When we got married in california she was making more money then me. We got married in 2006 separated in 2009 and I have proof of our separation due to separted addresses. When we were separated she lost her job and recieved unemployment for 2yrs. I need a lawyer to help me prove that she doesn't qualify for alimony

Alimony, or spousal support as it is called in CA, is based on need. So it would depend on her financial condition now.

No guaranty can be made but, based upon a short term marriage and 3-4 years?since separation, it is unlikely that a judge would award spousal support (alimony) and even if it was awarded, it would be of very short duration. Contact a family law attorney for assistance.

Contact your local Bar Association for a referral to a family law specialist. You will need to show what the marital standard of living was for 2006-2009. There are various factors the court looks at including what each of you has acquired during separation. If she's not working, you may need to file for a hearing to get her to make job contacts.
