QUESTION

How can I be divorce my husband if I don't know where he is?

Asked on Aug 26th, 2013 on Divorce - Florida
More details to this question:
I've been separated from my husband now since 2009. I've tried looking for him so that I can get a divorce. I am now living in Texas and we were married in Florida. I cannot find him nor am I able to go to Florida or really afford a lawyer. We have no children or personal belongings of each others. I need to find an easy way to get a divorce obviously without him because he is nowhere to be found. I need to move on with my life.

In Florida, having been a resident for at least 6 months, you could publish in the local newspaper, and because of that, could get a divorce. I do not know if there is a similar procedure in Texas, but there probably is.

You have to do an affidavit of diligent search then publish notice. You live in TX so you have to file the case there.

Florida allows Service of Process by publication. It is a complicated process and I really recommend you retain someone who knows what they are doing. It takes about 120 days to go thru that system.
