How can I file for divorce if I am on fixed income?

More details to this question:
My husband and I have not been together in three years. He left our baby when he as three months old for this woman. We have been together for 18 years and been married for eight years. I want a divorce. The love and trust is gone. He makes over $5000 and trying to give me $200 a week.

File for divorce and for a hearing on child support alimony and attorney fees. Find an attorney to help you or try Legal Aid.

The same way anyone would, file for divorce and serve your spouse. You can Google [your state] + Family Law forms and use the forms to represent yourself. The child support guidelines will determine child support, it is simply up to the parents.

There is no cost or low cost assistance available to you. You can apply for child support through the local child support agency. You can file for dissolution and apply for a fee waiver and then motion the court for spousal support which can be collected along with your child support by the state. You should consult the family law facilitator to assist you with the dissolution paperwork.

You may represent yourself. Most courts have clinics which will help you fill out the papers. You should file for support too.

See if there is a legal aid office in your area that may represent you at no charge. Otherwise, it will be difficult to get your case filed without hiring an attorney . You may also be eligible for spousal support.

Being on a fixed income should not discourage you from filing for divorce. The Court has the ability to award you temporary child support, and maybe even temporary spousal support, if certain criteria is met. The Court can also make your spouse responsible for paying some, or all of your attorneys' fees. You should discuss your situation with an attorney so that you are fully informed of your options.
