QUESTION

How can I find out if I am still legally married?

Asked on Jan 22nd, 2014 on Divorce - California
More details to this question:
How can I check for free in Yuba county, CA? I got married in 2002 and filed for divorce a few years later. Went to the court date as stated when I filed. The judge told me I had to refile. Why?

If it has been over 5 years since there was any activity in a case, and it was never finalized, you will have to re-file.

You need to look at the file. I cannot guess from here what occurred. You could probably send a check to the clerk's office not to exceed $25 to get a copy of all the documents in the file.

If you were informed by the court to refile and you did not then you remain married. You should consult a family law attorney or facilitator to review your paperwork to determine what the problems are that need to be corrected.

I'm betting that the Judge told you that additional documents had to be filed. The cheapest way to go on something like this is to hire a paralegal in the Yuba County area who can look into things and see what needs to be done to finalize your divorce. I'll bet that all you need is additional documents taken care of to wrap it up. Good luck

Just go to the court clerks office and look up you and your husbands name and see if a dissolution was filed.

What reason did the Judge give you? Do you have a copy of your entire file, so that you can find out why? Did you re-file and get him personally served, and then get a Final Judgment of Dissolution? It sounds like you need to get a copy of your file so that you can see where everything stands. There is a copy fee per page, but you may also be able to look at the entire file at the courthouse and only takes copies of the most important pages.

The only way you can find out is to go to the Court, pull the file and have it reviewed. Did you ever get divorced?
