Asked on Dec 17th, 2013 on Divorce - California
More details to this question:
I left my wife some months ago. She and I are now living separately and she has refused to respond to any of my attempts to establish contact. She does not know where I live. I would like to find out if we are still legally married. How can I find out if she has filed for divorce or if a divorce has been granted?

If your wife has divorced you, by a default divorce, it would have to have been filed within the Judicial District in which she is a resident. You can telephone the Court Clerk and ask if there is a filing under your wife's name or you can just go on-line yourself, to the Court Records site and check it out.

If she has filed for divorce, you would have to be served unless she does not know where you are. She could serve you by posting. First place to look to see if she has filed for dissolution is at the Court house in the County in which your wife resides. You may be able to do an online search of the Court house records where you wife lives. If you cannot do an online search, go to the Court house and ask the Family Law clerk to check the files.

Call the court in the county where she lives and she if there has been a case filed. However, if you have not been served with the summons and complaint, it is doubtful that you are divorced.

You should contact the court in the county where you, she or both of you reside and ask them to look and see if anything was filed and, if so, the status of that filing.
