How can I get my divorce?

More details to this question:
I have not lived with my husband for five years. We have no marital property. I want a divorce. I purchased no fault paper because he agreed to sign but now he is playing games.

I am not sure what you mean by "no fault" papers. If he won't sign what you have, file a petition for dissolution of marriage, have him served and proceed from there. You might need to hire a paralegal to help you maybe not. Give it a try and see how you do. good luck

As long as you are a resident for at least 6 months, you can simply Petition the court for a divorce. You should speak with an attorney to understand all of your options and so that your interests remain protected.

You can file, he doesn't need to sign. Court will try to serve him and if they cannot get service you can ask them to publish it. unless he has a valid argument, he can't force you to stay married to him. He can just delay the inevitable.

File your pleadings and force him to respond. If he doesn't, then you might be able to get a default judgment.

You would need to file the Complaint, have a Summons issued and have your husband served. That would start the process. Depending on whether he answers or not there are various options to proceed to Judgment. This is a no-fault divorce state so he cannot stop the divorce process.

If he is refusing to cooperate, you will need to file papers and have him formally served. You should consult with an attorney in order to be sure everything is properly done.
