How do I begin the divorce process and where should I start?

More details to this question:
I am seeking a divorce. I am in a nursing home and it seems my wife has made the decision to leave me here. She has assets and a pension and thinks she can go on with her life and leave me here. We have been married for quite some time. How do I begin this process?

You need to consult with and retain an attorney to assist you. The attorney can draft the papers that you need to sign in order to start the divorce process, and get them filed for you and served on her. You need to file a legal action immediately to prevent her from moving. If you have already been established as the biological father, then you should be able to stop her relatively easily. If you have not already been established as the biological father, then you need to do that first. You need to consult with an attorney immediately. You really need to hire an attorney, given your situation. If her assets and pension were accumulated during the marriage, you are entitled to your share of those assets, and possibly alimony if she is working and has a significantly higher income than you.

The first step, which should be taken very promptly, is to retain an experienced family law attorney and give her or him all the facts and details relevant to your situation. He or she will prepare and file a divorce petition, if that is your ultimate decision. The lawyer you retain can, and should, explain the rest of the process to you. Good Luck.
