How do I divorce my wife?

More details to this question:
We have only been married for six months. We have no children and no property. I do not even know where to begin this process. We are not on the best terms although she does not object to the divorce.

If you do not have real property, joint accounts or debts, or children, you could use the self help forms on the Nebraska Supreme Court website. Otherwise, you should visit with an attorney about your options.Best wishes.

First things first. Retain a lawyer. A lawyer can only represent one of the two spouses, but you can instruct him or her to conduct matters in an amicable and fair way. If there are no children and no property, the divorce can be quite simple. In some counties there is a family law clinic (about which you can call the Clerk of Court to ask if, where, and when), which can help you with some standard forms. Good Luck.

You have to either reach a settlement agreement and then file a divorce action, or you need to file a divorce action and have her served and then proceed. If you are in agreement on everything, you could potentially be divorced within just a couple months. If not, then it will take longer. You should consult with an attorney in order to best determine your potential rights and options, as well as determine how to proceed.

Clearly would behoove you to engage an attorney to assist. Will have to file in the proper court and jurisdiction and provide the necessary paperwork and judgment. If you value your time, it is doubtful that you would be saving anything by attempting to do this alone.

Give what you have said, think about Mediation. Mediation is Fast, Effective and Affordable. With no property, no children and a short term marriage the cost would not be more than around $500 plus court costs. Good luck.
