QUESTION

How do I file for an international divorce?

Asked on Feb 10th, 2015 on Divorce - California
More details to this question:
My husband and I were married in England in April 2011. We have been separated for two years and have no children. He was born in England and is a U.K. subject. I was born in the US and am an American Citizen. How do we obtain a divorce with the least amount of money and preferably no money? He hasn't been very responsive to seeking a divorce, however he is starting to cooperate more. Please help me end this marriage.

You can file in your domicile and probably the law of the U.K. allows him to do so there. If he is not a California resident, the California Court can terminate marriage but will require his consent to address determination and award of assets and debts; he can consent to avoid any such problem simply by ignoring the problem.

You may file wherever you qualify to file. You didn't state where you live specifically, but so long as you are a resident of California for the last six months and have been in the same County for the last 3 months, you can file where you live. He can either be served by mail if he will sign and return the Notice and Acknowledgment off Receipt, or you will need to have him personally served. The court's jurisdiction over some issues may be limited because of where he lives, however the court can terminate your marital status.

You can file for divorce where you have lived for six months. Citizenship doesn't matter. The California family law courts have self help departments. Go see the one in your county for help. Good luck.
