QUESTION

How do I find out if I am divorced?

Asked on Jul 02nd, 2014 on Divorce - Florida
More details to this question:
I'm fixing to get married but not sure if I am divorced from my ex-wife. I called the courthouse to get public records and they say they have no record of my divorce being filed. I remember an officer showing up at my work with divorce papers but not sure why I can't access them.

Check the clerk or pay for a local/state/nationwide court search.

NEVER rely on nameless clerk/voice on the telephone. Go to the courthouse and make a personal inquiry. It is possible suit was filed but was dismissed due to no follow up. Also if you were separated check clerk office for the county where your spouse was living.

Best way to find out is to go, yourself, to the Courthouse and look up your record. Even better if you have a case number to use as your tool to look up.

You could always start by contacting the clerk of court and giving them the case number from the papers you were served. You could also just contact your ex for information or a copy of any final judgment that was entered. If that is not workable, then contact the clerk of court in the county in which the divorce was filed, or check out the clerk of court's website and do a case records search on your name and your ex's name.

Generally a signed Final Judgment of Dissolution of Marriage is recorded in the public records of the county where the divorce proceeding took place.

I guess you have to go to the court house and look for yourself. Are you sure it was in your county? Perhaps it was in another county.
