How do I find out if my husband divorced me?

More details to this question:
In 2002, I left my husband. We had resided in Nevada for 2 years together. I moved to Washington State to be around 2 of my boys. When I left, I told my husband that if he wanted a divorce he could file and I sure wouldn't protest. I have not spoken to him since but have been told that he still lives there. I recently moved back to California and am just curious as to whether he has gotten a divorce or not. Thank you so much for any help.

You would have to check with the court in the county where you lived together .

The easiest thing to do would be to reach out and ask him. If he says you are divorced, ask in which court and then get copies of the final paperwork from that court. Otherwise, you will need to check every District Court in Nevada to see if he filed. Normally people would file in the county where they reside, but in many cases when they use paralegal services, they file in other counties where things move more quickly and/or with less questions asked.

You could call the Clark County Clerk's office; with names, they should let you know if there is a case with your name on it. Any lawyer who subscribes to "Odyssey" could also do a search for the file.

Court filings can be check to determine if a divorce case exists. An attorney, paralegal or attorney service can assist. There are database searches on the internet they may be helpful also. Once you find a case filed, you need to check if a judgment was entered.

If he knew where you were, he had a duty to serve you with his petition for divorce. If he didn't it could have been done by publication. Contact the county court where he lived and see if there is a divorce decree on file. Otherwise, you can file a divorce where you are since there are probably no property issues at this point.

You can look it up on the court website in the county where he had residence at the time he filed. However he would have had to serve you papers in order to get a divorce.
