QUESTION

How do I get ex spouse off the deed?

Asked on Apr 30th, 2013 on Divorce - Texas
More details to this question:
I purchased a home in January of 2012. The mortgage is only under my name. I put my boyfriend's name on the deed at that time. We were married in July of 2012. We were separated in March of 2013. I have an order of protection against him and the judge ordered him to leave the house. I am filing for divorce. He never paid anything for the mortgage or contributed to any bills in the house. What are my chances of getting awarded the house without having to pay him anything?

Ask the court to put in the divorce decree that he has no interest in the house and that, if he refuses to quit claim the property to you, that you can record a short form of the decree as proof he has no interest in the property.

Slim and none. You might get off with paying a small amount but most likely you are going to have to pay him something. Next time think twice about putting someone on the deed, especially if they are not on the mortgage too.

You need to consult a family law attorney to review all of the facts to see what you will have to do with regard to the house. If the house is awarded to you, the court will order him to sign over the deed or will do it for him.

Your question does not contain enough factual info to provide you with a specific answer. Generally, signing a deed that gives a person an interest in real property is viewed as a gift and makes that person's interest his/her separate property. I suggest you hire a lawyer to give you an answer based on the facts of your situation.
