How do I get my husband's name off a title?

More details to this question:
My husband and I are getting a dissolution. We have a timeshare in both our names and have agreed it will go to me. How do we get his name off?

He will have to sign a deed either quitclaim or warranty.

Easy, have a deed drawn up to transfer title, but it would be best to have a court order in a divorce action awarding you the timeshare before you execute the deed.

He signs a quit claim deed to you. Just make sure it is properly notarized, etc.

You execute a quit claim deed. This should happen as part of the final decree and property settlement not before all property issues are settled.

You will need to negotiate a new contract with the lender on the time share to get your husband's name off title. The best thing to do is check with the time share administrator to see what is needed to get hubby off title. Good luck

What you would have to do is go to the lender and ask the lender what their requirements are. If there is no lender, than just enter into a written agreement with your husband and have him sign the title and deed over to you, then do a proper filing with the County in which the timeshare located.

You need to deal with the timeshare directly. They probably have rules about how to do this because of the financial obligation and this is not their first divorce.

Typically the title to property is changed by way of a community property partition agreement. If this is the only property owned by the two of you, it may be cheaper to just do an act of donation.
