QUESTION

How do I go about getting the house settlement awarded during my divorce?

Asked on Dec 03rd, 2012 on Divorce - New Jersey
More details to this question:
My ex husband was given a year to pay the settlement as he claimed he would pay from his 2011 April tax returns. In the divorce papers, it was put in that if he didn't pay, then the money would be taken from his 401k. How do I get that process started?

To start this process, you will have to file a motion in the Superior Court in the county where the divorce was put through.  If you would like to discuss this, I am available for a consultation.  My office number is 201-440-6300.

You need to file a motion to enforce litigant's rights.  Its a post judgment action.  You will be able to ask for fees if you hire an attorney to file it for you.  You should go to the court in the county in which your divorce was granted and ask if they have the paper work for the motion.  you can also get it online at the New Jersey Judiciary website.  Good luck.
