QUESTION

How do I know if I am legally divorced?

Asked on Oct 02nd, 2013 on Divorce - California
More details to this question:
Went through divorce process ourselves in CA, no disputes of any kind. I received a FL-825 back with the dates Aug 30 2013 stamped all over and it states a judgment of dissolution of marriage was entered on Aug 30 2013, but other verbiage conflicts with the idea my divorce is final. Upon looking the case up it says the status is pending. I just want to know if I am divorced yet, what this actually means, and if not what is ETA?

Look at the date in item 1a. That is when your dissolution is final.

You are legally divorced as of the date indicated on your Judgment which would be August 30, 2013. The case status online is not always updated and you can not depend on it for accuracy. Your Judgment with the filed and entered date of August 30, 2013, indicates that you are divorced. You are back to a legal status of single as of the date of the entry of the judgment. I can not comment on the other language you describe being contrary to your divorce being final without additional details.

It sounds like you received a status only judgment with issues reserved [still to be resolved/litigated] so you are no longer married, but you still are tied to the ex by whatever financial or custody issues remain. The court will not do anything t move these issues to resolution- that is up to the parties (or their counsel).
