How do I stop my estranged husband from breaking into my house?

More details to this question:
Separated, hubby, 54, lives in his house with another woman. While hubby was said to be out of town, my home was broken into. I filed a police report, and reported to the insurance co. Next day ppo and filed for a divorce, gut instinct said he had something to do with it. Two months forward, I find my stolen items for sale on Craigslist with him as a contact. Can I press charges?

If where you live was the marital residence, and there was no court order giving you exclusive use, he has a right to come in. If the items he has for sale are marital, you have a right to half the proceeds of what's sold. If the items are your, non-marital property, you have a right to recover them. However, you will probably have to do so in the divorce. I doubt the police will file charges.

I would and I would let the police know about this and your divorce lawyer.? They can get an order prohibiting the sale.

Minor technicality: you do not press charges, the district attorney presses charges. Otherwise: YES! Copy the Craig's List listings and take them to the police station!

If he is selling your stuffg on Craig's List, it sounds like he may have had something to do with the theft. I would contact the police and file a report

Yes. Notify the police. If he has been served with the divorce Summons and Complaint, then he should know he is under an order NOT to dispose of his property, your property, or your joint property.

You can call police and make a report. They will discuss it with the prosecutor to determine if they have sufficient evidence to file charges.

If you filed a police report at the time of the break in, follow up with your new information. The police and prosecutor will decide what action to take, if any. He may claim ownership of the items.

talk to the police about whether the prosecutor will prosecute. It will also be an issue in your divorce. Print the Craigslist ads before they disappear. May not prosecute because he may be selling community property. But still an issue in your divorce.

You can attempt to make police report and have him charged with the burglary, however, most of the time the authorities do not wish to get involved in a domestic dispute. Therefore I would suggest that you print down whatever you can from craigslist in order to be able to prove the court, at your divorce, that he had taken and sold marital items including your personal property. If you do not have an attorney, retain one now.
