How do my pre-nuptial agreement be not imposed?

More details to this question:
My husband filed for divorce I signed a pre-nuptial agreement. I never got to read it before we got married. I just saw it few months ago. I have no job. I have a son who is fifteen whom I raise by myself. I’m trying find a job. I love him but he won’t answer my call, etc. I filed my own response. I just don't know what else he is going to do to us.

The court does not automatically know you signed a prenuptial agreement. If it is enforceable, it is up to you to assert your rights under it in the divorce proceeding. The money your husband is currently making is community income, and you may be able to get a court order for temporary support, including attorney fees, in order to make sure you and your child are properly looked out for in the proceeding.
