How do we get a divorce if we have no money?

I am 67 years old and my husband is 60. I only get 879 social security a month. He makes around 250 per month. Both of us have health problems. He has no insurance. The divorce will be UNCONTESTED. We have agreed on how property will be divided. I will keep my house, which I had before the marriage. There is no mortgage. I have no money. What is the best way to get out of my situation?

In Arizona, at most superior court facilities, there is a self service center that can provide you with forms and instructions to file and process an uncontested dissolution of marriage.

You should consult a family law facilitator to assist you with the paperwork which should include a request to waive filing fees.

Mediation is the means by which to obtain a divorce at minimal costs. The mediator will be able to prepare and file all required forms with the court from the beginning to the end of a case without any need for you or your spouse to even go the courthouse to a file a piece of paper. The total costs depends upon the hours spent with the mediator. Most uncontested cases resolved through mediation cost less than one retainer paid to hire an attorney.

It sounds like it would be relatively simple to get you divorced, but there are some very confusing forms for lay people to fill out which are required before a divorce can be entered. If you do not have the financial wherewithal to pay court fees or retain a family law attorney to help you, I would urge you to contact the local bar association or Superior Court and ask if they have a self-help center that they can direct you to who can help.
