How do we proceed with our amicable divorce?

More details to this question:
My husband and I have been separated for 6.5 years and he has had no contact with our children. I recently asked him about divorce and he agreed to no visitation. He said he would sign papers when I finished filling them out. Do I have to have them served or can he just sign them and I can turn them in?

My initial advice is to first at least consult with an experienced family law attorney to assist you. In Arizona there is a self service center at most county superior court facilities, and also forms and instructions are available online. There are various steps that must be taken before an agreement to give up rights will be enforced by the court. I suggest you meet with a family law paralegal to help you prepare the multitude of forms and documents you will need.

It is not that easy. Go to your local family court and see if there is a facilitator there to help you do things correctly.

Have you considered Mediation? Mediation is Fast, Effective and Affordable. If you both agree to mediate, it can be done within a short amount of time. The Mediator can also assist you with all the required forms that will be necessary to file with the Court. Good luck.

1. He can sign and the Judge will accept. 2. Even thou he is waiving contact with children Judge is required to assess Child Support.

This is a very simple process since you are both agreeing to the terms. You will still need to file a Petition for Divorce, but no need to serve him if he is willing to sign a Waiver of Citation. A Final Decree of Divorce will also need to be drafted. I could do all of this for you for roughly $1,000.
