QUESTION

How does a person proceed with divorce in NY without a lawyer?

Asked on Jul 12th, 2014 on Divorce - New York
More details to this question:
I have a friend who lives in NY who wants to divorce his wife. The main reason is that she has been verbally abusive for years and they have both cheated throughout the course of their marriage. They don't own any property between them (renting) except a car that is in his name and they do have 4 children (all under the age of 8). My questions are: 1) Are the reasons I stated grounds for a divorce? Does he need proof? 2) Does he need a lawyer before he files? 3) What should he do if he cannot afford an attorney? Thank you in advance for your time and help. sj

1) You don't need grounds or proof other than a swo 2) There is no legal requirement that he have an attorney - but with custody and child support issues it may be prudent to retain one. 3) He can try to work his way through the case without an attorney. It won't be easy.
