How does infidelity affect the terms of a divorce?

My husband recently told me that he wants a divorce because of irreconcilable differences, but I found out that he is having an affair.

California is a no fault state in regards to divorce. It does not matter as to the grounds for a divorce whether or not he had an affair.

California is a "No-fault" divorce state. There are no grounds other than irreconcilable differences that need to be proved. Infidelity does not change the divorce terms.

In California the standard reason for dissolution is irreconcilable differences because dissolution in this state is no fault. Regardless of what the underlying cause really is, the assets of the couple will still be divided equally. Therefore, infidelity does not affect the terms of dissolution. However, if you have children, the presence of a girlfriend may affect visitation. You should consult a family law attorney to review all of the facts and advise you.

In Calif there is no legal relevance to infidelity. We are a community property state and that's it.
