No one is required to hire an attorney, you may represent yourself in court. However, you are still held to the same laws and rules. If you have not done your paperwork correctly, it will be rejected. You also may not know everything to include for your own benefit (meaning your papers would meet minimum legal standards, but might not be in your best interest). If you go forward on your own, do your research and get all the help you can from the self help center at your family court (they cannot give you legal advice, but can help you with the process and paperwork). In California, the MINIMUM time required before a divorce can be granted is six months and one day after the Respondent is properly served with a copy of the dissolution paperwork (which you previously filed at the court). This assumes everything runs smoothly, the two you are able to settle the case, and there are no set backs in the process.

Why do you ask about each state? The only State that counts is the State in which you are a resident. In Florida, a divorce can take as short as a few months to as long as more than a year. The time will depend upon whether you and your spouse can come to a mutual agreement on all issues.
