QUESTION

How long does it take to prepare a subpoena?

Asked on Dec 02nd, 2013 on Divorce - Florida
More details to this question:
I have been trying to move my divorce case since June 2013. I paid my retainer fee but nothing after that because it has been like pulling teeth to get the lawyer to give me updates. Anyhow, in July my lawyer supposedly sent interrogatories and no answer from opposing council. After weeks of excuses, vacation and personal illness, my lawyer finally produced a letter that was sent to the other lawyer. To this date no answer from opposing side. Beginning November I continued to ask for updates and I was eventually told that subpoenas might have to be requested from my ex's HR department. It's December and I haven't heard from my lawyer. I want to know even if lawyers have other cases, how long does it take to prepare subpoenas?

If you don't think your lawyer is doing a good job, report him to the bar association. Also, you can get another attorney to replace him.

It should not take that long. Perhaps if you sent a inquiry to State Bar Association with a copy to your lawyer, your case may move along a bit quicker. Keep in mind, however, if you do that, your lawyer may resign from the case which would then put you in a bind to find another lawyer.
