QUESTION

How much am I responsible with my spouse?

Asked on Sep 16th, 2012 on Divorce - California
More details to this question:
My wife and I have been legally married for over 50 years. I was released from the US Army in 1975 with 17 years’ service and 50% disability. A few weeks ago, I was granted 100% disability by VA. My wife, I & our lawyers signed a separation agreement on 10/15/2008. What is involved here is Tricare, SBP, alimony & the divorce itself. Until I received the 100%, I could not afford what she said I would owe her. The result of this agreement led to her assets being greater than mine. What else do you need to know?

It depends on the terms of your separation agreement. If they did not cover this situation you or she may be able to go back to court.

I need to know if there is a Judgment in the dissolution action. If not you may have be able to set aside the settlement agreement. Even if you do have a judgment you can try to set that aside also as long as you file your motions timely (usually within 6 months).
