You cannot be married until 6 months and 1 day from your ex being served. You must get a judgment saying what day status ends. After that day you can remarry.

Once your divorce has been finalized you can proceed to get remarried. You may want to try to bifurcate status if you have already filed for divorce and it has been pending for at least 6 months. If you have not filed for divorce then you need to start the process. The fact that you have been separated for awhile is not going to help in regards to remarrying.

The earliest you can be divorced is 6 months and 1 day from the date the Petition was served on the other party. Upon entry of a Judgment terminating marital status, you can remarry that same day if you want. There is no waiting period.
