So I filled for divorce in February 2013. The stamp that shows the court received my papers and his papers with all the required signatures was stamped in April 2013. In the website of the Los Angeles superior court says the case is pending. Hearing: none. Proceeding: none. We have no kids, no property, and no other important issues, and both just want to get a divorce and get this over with. I waited my 6 months and 1 day. Why is it still say pending? Is California being broke and all the budget cuts effecting my divorce papers and it might take longer for me to be divorced, I wanna know does this mean I am divorced or it's still in process? Filing Date: April 04, 2013. Case Type: Summary Dissolution (General Jurisdiction) Status: Summary Judgment. November 07,2013: Documents Filed (Filing dates listed in descending order) November 07,2013: Request-Final Judgement (Sum Diso) April 04,2013: Order-Court Fee Waiver-Filed by Petitioner. April 04, 2013: Request- Waive Court Fees-Filed by Petitioner April 04, 2013: Judgment-Package received summon from judge April 04, 2013: Petition-Filed by Petitioner.
You do not get divorced just by filing your initial papers. You must take affirmative action to terminate the marriage. I suggest you consult with a family law attorney.
You still have to submit paperwork to the court for the divorce to be final. The court's doesn't automatically make you divorced after 6 months. Check the court's website and see what you missed probably judgment and notice of entry of judgment.
