husbands pension after divorce

More details to this question:
live in ny. husband not retired yet from NYFD. we are getting divorced. He does not know when he will retire. how will i know when he does retires. when he does retire is he able to withdraw his funds without me knowing.

If you do not have proper orders filed as signed by the court there is no way that you will know or be able to prevent something like that. If you do have proper orders if something improper happens you'll at least have recourse.

Your lawyer will file a Qualified Domestic Relations Order (QDRO) that will get signed by the Judge. Once the QDRO is signed, it will need to go to the retirement Plan. When your husband retires, the Plan administrator will know to send you the share you are entitled to under the QDRO. Good luck!
