QUESTION

If I am on Deferred Retirement Option Program DROP retirement, is she entitled to it?

Asked on Jun 06th, 2013 on Divorce - Florida
More details to this question:
I am on the DROP retirement in Florida and getting divorced. I did not in any way contribute any marital money to it and neither did she. The retirement was provided by the city as a benefit. I was married for 4 1/2 years and then separated. I would like to know if she would be entitled to some money even though we did not put money into it from my pay check. Thanks

She would be entitled to the marital portion of the retirement if you were working and married during the same time.

It was a benefit earned by you during the marriage, apparently, and as such she would be entitled to one-half of that benefit which was received during the marriage. There are all sorts of ways to negotiate around things like this.
