QUESTION

If we were married for 20 years, can I ask for alimony?

Asked on Aug 07th, 2013 on Divorce - California
More details to this question:
My husband and I were married for 20 years, raising 4 kids. I've never worked. He asked me to stay home and raise the kids. Years go on and on, things get bad, bipolarism, and I stepped out of my marriage 18 years into it. Now he is kicking me out every 2 or 3 days. I am tired of it. On 6/20/13, we were supposed to make it work, but he decides to kick me on my ear. I am homeless, never worked, scared, childless, and depressed. Is it possible to ask judgment for alimony to rent apartment, spousal support, custody of the kids maybe 60-40. And money for dental restoration. He had promised me with every years taxes, never happened.

Short answer is yes. There is presumption in favor of alimony in any marriage lasting over 17 years.

If you are in Florida, then you are probably entitled to alimony. Whether you are in Florida or not, you need to consult with an attorney in your local area so that you can best determine your potential rights and options. Many attorneys offer free consultations over the telephone, so perhaps you can find someone to help you.

Sounds like you are a perfect example of a woman who deserves alimony (also called spousal support). Contact a good family law attorney.

Spousal support is normally granted to all spouses who need it on a temporary basis and then permanently for spouses who need it when the marriage lasted longer than 10 years. You should consult a family law facilitator or child support agency to assist you in preparing the proper paperwork.
