QUESTION

In Florida, will they include my income in my husband's child support?

Asked on Jul 24th, 2013 on Divorce - Florida
More details to this question:
My husband has a child from a previous marriage. He has been paying child support for him since 2007 when they split. The child's mother recently became angry with him and said she's going to take him back to court for more child support because we are now married. Will a judge include my income? We also have had two children together since he initially got on child support. Will they take that into consideration?

1. After born children are not taken into consideration 2. Your income is not considered however if your husband works less or not at all because you have a good income then to extent he gets free things, this will be taken into consideration.

Your income is absolutely NOT includable in your husband's income for purposes of calculating child support for his child from a prior relationship. If his ex brings an action for an increase in child support, when your husband provides his financial disclosure in that case, he needs to be careful to redact your information from the disclosure, such as on copies of your joint tax returns that may have to be provided.

Your income is not considered and neither is the fact that he has had two more children after the first.
