You must meet the standards for Nullity which are generally fraud and bigamy. The fact that a spouse was in prison in and of itself would not be determinative.

Annulments are disfavored. You need to provide the court with some legal reason for why one should be granted. If he was in prison at the time you got married, then the fact that he is there now isn't terribly relevant.
