Is divorce the only option when one spouse is non-compliant bipolar?

More details to this question:
My husband is dangerous without his meds. He frequently goes off them. Can I make a legal agreement with him to stay on them? Is divorce the only way out? He has been lighting matches in the house and throwing them down. I don't want divorce. It will put me in the poorhouse after assets are divided. He will not have alimony to give because his mental condition precludes getting a good job. I'm 62 and can only perform a part time job.

I am not familiar with any ways to force someone to stay on their medications, this would probably be very difficult, if not impossible to enforce. It does sound like you need to be physically separated from your husband if you are concerned for your safety. A Divorce or a Legal Separation would probably meet your needs. You definitely need to consult with an attorney. Is he able to support himself without your help. Should one of you pay Spousal Support based on your higher earnings? Do you own a home that needs to be divided. What about retirement accounts? These are all questions that you need to go over with an attorney to make sure you tread carefully in his delicate situation to protect yourself physically, financially, and emotionally.

Dissolution is your only option unless your spouse's condition is serious enough for him to be unable to care for himself and a conservatorship is warranted. A conservator can insure that medication is properly taken. You should consult his physician and then see a family law or an elder law attorney, whichever is most appropriate to the circumstances.

Your choice let him injure you or divorce him. He will probably get worse with age. Is your standard of living worth your life. Divorce him and move on. You can work part time and maybe move somewhere cheaper.
